Federal Law on Imitation Firearms
The following regulations apply to toy, look-alike, and imitation firearms that resemble real guns and entered commerce on or after May 5, 1989:
1. Exemptions:
• Non-firing collector replica antique firearms manufactured before 1898.
• BB, paintball, or pellet guns that expel projectiles through compressed air or spring action.
• Decorative or ornamental miniature replicas smaller than 38mm x 70mm.
2. Prohibited Actions:
• It is illegal to manufacture, sell, ship, or transport any imitation firearm without required markings, unless an exemption applies.
3. Approved Markings:
• A permanent orange plug (minimum 6mm depth) affixed to the muzzle end of the barrel.
• A blaze orange exterior marking on the barrel (minimum 6mm depth).
• Construction from transparent or translucent materials for full interior visibility.
• Full bright color coatings (white, red, orange, yellow, green, blue, pink, or purple).
4. Waiver for Theatrical Use:
• A waiver may be granted for theatrical, film, or TV productions upon written request to the Chief Counsel for NIST at 100 Bureau Drive, Mail Stop 1052, Gaithersburg, Maryland 20899-1052. A sample item and a sworn affidavit confirming exclusive professional use must be included.
5. Preemption Clause:
• Federal law supersedes state and local laws that impose inconsistent markings or identification requirements.
